My name is Thomas Mulvihill and I am a licensed member of the State Bar of California. I practiced law as a civil defense and appellate lawyer for thirty three years. I now serve as a construction, securities and consumer arbitrator with the American Arbitration Association ("AAA"), the Financial Industry Regulatory Association ("FINRA"), and by private appointment.
During my legal career, I was a partner with the following law firms: Boornazian, Jensen and Garthe; Low, Ball and Lynch; and Lewis Brisbois. In addition to the above, I served in multiple legal management positions, including managing partner, board member and board chairman. Prior to attending law school, I was employed as a securities broker with Paine Webber Jackson and Curtis.
I am a graduate of the University of California, Berkeley and the University of San Francisco.. I am a licensed member of the State Bar of California, and I have previously held multiple securities licenses through the National Association of Securities Dealers.
During my career, I represented developers, contractors, subcontractors and design professionals as defense counsel. I have extensive litigation experience involving breach of contract, breach of express warranty, breach of implied warranty, negligence, strict liability, fraud, misrepresentation, statutory violations, licensure, express indemnity, implied indemnity, risk transfer, mitigation, statute of limitations, waiver and estoppel, contractual damages, tort damages, disgorgement, specific performance, pre-judgment interest, and awardable costs and attorney fees.
During my career, I represented international and domestic insurers as defense, plaintiff and coverage counsel. I have extensive analytical experience with Commercial General Liability Policies, Commercial Excess Policies, Commercial Umbrella Policies, Errors and Omission Policies, Commercial Property Policies, Commercial Auto Policies, Business Interruption Policies and Personal Lines Policies. I have extensive litigation experience involving breach of contract, breach of the implied covenant, duty to defend, duty to indemnify, right to independent counsel, equitable contribution, equitable indemnity, equitable reimbursement, waiver and estoppel, subrogation, reformation, recission, cooperation clause, supplementary payments, voluntary payments, broker negligence, contractual damages, tort damages and equitable remedies.
During my career, I represented broker dealers and registered representatives as general counsel and respondent's counsel. In addition to the above, I also represented securities investors as claimant's counsel in security malpractice actions. I have broad litigation experience involving excessive trading, unauthorized trading, suitability, manipulative conduct, breach of contact, breach of fiduciary duty, negligence, fraud, misrepresentation, statutory violation, unjust enrichment, elder financial abuse, contractual damages, tort damages, punitive damages, statute of limitations, pre-judgment interest and attorney fees and costs.
I argued multiple appellate matters before the California Court of Appeal, the Ninth Circuit Court of Appeals and the California Supreme Court. In additional to the above, I was a frequent public presenter on litigation and substantive law topics. A list of appellate matters and public presentations is available upon request.
I am a Fellow of the American College of Coverage Counsel (“ACCC”).
My experience as an arbitrator includes construction, securities, finance, automotive and commercial contract disputes. As an arbitrator, I have ruled on issues involving choice of law, pre-arbitration discovery, breach of construction contract, breach of securities contract, breach of commercial contract, professional malpractice, statutory violations, contractual damage limitations, fraud, misrepresentation, negligence, negligence per se, attorney fees, prejudgment interest and punitive damages.
